**By accepting this reservation, you agree to all terms and conditions of this agreement below.
MAXIMUM OCCUPANCY-The maximum number of guests is limited to eight (8) persons. However, without using the common areas the home is most suitable for five to six (5-6) people. There is an extra $100 charge for more than 6 people.
1. AGREEMENT:
The Owner and Tenant agree as follows: Booking Tenant is an adult family member (at least 24) and will be an occupant of the home during the entire reserved period. Other occupants will be family members, friends or responsible adults. (*For groups of, singles, students, e.g. spring break, an age minimum of 26 applies and $500.00 deposit is required.)
2. RENT PAYMENTS, TAXES, AND CHARGES:
a. SECURITY DEPOSIT: Owner shall have the right to make deductions from the security deposit for any missing, damaged, or broken items found in the Premises that were not missing or broken at the inception of Tenant’s occupancy. Tenant is liable for all replacements and repairs that are outside what is considered normal wear and tear.
b. CLEANING: Property will be inspected, sanitized, and cleaned after your departure. Tenant shall be responsible to pay a cleaning fee in the sum of $255. Such cleaning fee shall be for ordinary cleaning of the Premises. However, if 6 people stay we add an extra charge of $65 to the cleaning fee. If the Premises is left excessively dirty, Tenant understands and agrees that Tenant shall be assessed an additional cleaning amount at Owner’s discretion depending on the condition in which the Premises are left. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted, and sanitized.
c. DOGS: Dogs are not allowed.
3. CHECK-IN:
Check-in time is 4:00 PM. THERE IS A $20/HR EARLY CHECK-IN FEE. EARLY CHECK-IN TIMES ARE ALLOWED ONLY WHEN THE PROPERTY IS CLEANED AND READY FOR OCCUPANCY AND PRIOR APPROVAL IS REQUIRED. Codes will be sent by Host to guest with reservation.
4. CHECK-OUT:
Check-out time is 11:00 AM. THERE IS A $20/HALF HR FOR LATE CHECK-OUT.
5. WHAT WE SUPPLY:
The property is equipped and set up as a fully furnished property that will include bedspreads, linens, blankets, pillows, and towels, as well as a fully equipped kitchen.
a. UTILITIES. Owner shall pay for electric utilities and water for normal use measured by that of previous Tenants. If the Tenant uses an excessive amount of electric due to misuse or abuse (i.e., leaving the doors open with the air conditioning on) then Tenant shall be responsible for any excess use of utilities above the normal quantity. Tenant shall be responsible for Tenants telephone call, web streaming/ demand usage. Discounts could be denied, at owner’s discretion, due to repair costs. Owner will provide Flatscreen TV service and High-speed Internet during the Lease Term at no additional charge to Tenant.
6. TENANTS LIABILITY:
Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenants guests. We will do a walk-through after your stay and charge you for any missing items or damages to the property. Tenant shall return all keys/remotes to the Premises to the Owner on the last day of this Lease. If any of the keys/remotes delivered to Tenant are not returned on the day of the expiration of this Lease, Tenant shall be charged two hundred fifty dollars ($250.00) to change all locks/ and four hundred and fifty dollars ($450.00) to replace remotes to the Premises .two remotes are included with the rental. Additional gate features will be explained by Host on how to use the outside code and pass key opener. Tenant further agrees to adhere to the strict garbage and recycling rules in the City of Ft. Lauderdale. Tenant will be responsible for any fines imposed due to violations by Tenant. GREEN PAIL is for landscape waste only and no regular garbage (pick up Thursday morning). BLACK PAIL is for all regular garbage which must be bagged and tied. (pick up Monday and Thursday morning). BLUE PAIL is for all plastic, glass, cardboard, and paper recycling (pick up Thursday morning. Please do not put any regular garbage in the GREEN yard waste pail and try to recycle all glass and plastic in the blue pails. If you need additional pails, please ask Host.
7. SLEEPING CAPACITY/DISTURBANCES:
Tenant agrees not to use the Premises for parties or gatherings of more than 10 people. As the Premises are located in a quiet and exclusive neighborhood, Tenants agree to adhere to The City of Fort Lauderdale’s noise ordinance which states:
Any sound shall not plainly be audible for a period of one (1) minute or longer at a distance of twenty-five (25) feet or more when measured from the source property line between the hours of 10:00 pm and 7:00 am daily and at a distance of fifty (50) feet or more when measured from the source property line between the hours of 7:00 am and 10:00 pm daily.
8. USE OF PREMISES:
This home is in a residential area. The home is not suitable for parties, events, or entertaining large groups. Only members of the renting party are authorized to stay overnight in the house. Please be considerate of neighbors and refrain from loud noise and music outdoors after 10:00 PM local time. This is also a NON-SMOKING HOUSE. Smoking of any kind is NOT allowed inside or outside. If you smoke inside or we must pick up cigarette or cigar butts or damage to chase chairs from them or other trash, we will charge you $125.00 for repair/trash /smoke removal. Please do not move the furniture or rearrange or remove any contents of the house. This includes moving indoor furniture outside and outdoor furniture inside. The house has NOT been childproofed. Please exercise extreme caution with children around the Hot tub, electrical outlets, kitchen, bath, grill, and any other areas where a reasonable person would understand the potential dangers.
9. RISK OF LOSS/INSURANCE:
OWNER, ITS AGENTS AND EMPLOYEES SHALL NOT BE LIABLE FOR, AND TENANT WAIVES ALL CLAIMS FOR, LOSS OR DAMAGE INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL DAMAGES, TO PERSON, PROPERTY OR OTHERWISE, SUSTAINED BY TENANT OR ANY PERSON CLAIMING THROUGH TENANT, RESULTING FROM ANY ACCIDENT, CASUALTY OR OCCURRENCE IN OR UPON ANY PART OF THE PREMISES, INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR DAMAGES RESULTING FROM:
(a) any equipment or appurtenances becoming out of repair;
(b) Owner’s failure to keep any part of the Premises in repair;
(c) injury done or caused by wind, water, or any other natural element;
(d) any defect in or failure of plumbing, heating or air conditioning equipment, electric wiring or installation thereof, gas, water, and steam pipes, stairs, porches, railings or walks;
(e) broken glass;
(f) the backing up of any sewer pipe or downspout;
(g) the bursting, leaking, or running of any tank, tub, washstand, water closet, waste pipe, drain, or any other pipe or tank in, upon, or about the Premises;
(h) the escape of steam or hot water;
(i) water in or about the Premises;
(j) the failing of any fixture, plaster, or stucco;
(k) damage to or loss by theft or otherwise to property of Tenant or others;
(l) acts or omissions of persons in the Premises, occupants of nearby properties, or any other persons; and
(m) any other actor omission of owners of adjacent or contiguous property, or of Owner, its agents, or employees.
All property of Tenant kept in or about the Premises shall be so kept at Tenant’s risk only and Tenant shall save Owner harmless from claims arising out of damage to same, including subrogation claims by Tenant’s insurance carrier. Tenant hereby further agrees to indemnify and hold Owner, and his agents and employees, harmless and to defend Owner against any and all claims, actions, damages, liability, and expense in connection with loss of life, personal injury and/or damage to property arising from or out of any occurrence in, upon or at the Premises, or the occupancy or use by Tenant of Premises, or occasioned wholly or in part by any act or omission of Tenant, its agents, contractors, employees, servants, invitees, or concessionaires. In case Owner shall be made a party to any litigation commenced by or against Tenant, then Tenant shall defend, protect, and hold Owner harmless and shall pay all costs, in connection with such litigation. Owner shall have the absolute right to control any such litigation and or representation, as well as the terms of any settlement thereof. Tenant shall pay all costs, expenses, and reasonable attorney’s fees that may be incurred or paid by Owner in enforcing the covenants and agreements in this Lease.
10. HOLD HARMLESS:
The owners do not assume any liability for loss, damage, or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. Nor will the owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond their control.
11. CANCELATION POLICY
Strict cancellation policy: To receive a full refund, guests must cancel within 48 hours of booking, and the cancellation must occur at least 14 days before check-in.
